REPORT AND RECOMMENDATION
BAKER, Magistrate Judge.
13, 2016, the Court held a hearing on the Petition for
Warrant or Summons for Offender Under Supervision filed on
April 16, 2015. Defendant Edwards appeared in person with his
appointed counsel William Dazey. The government appeared by
Winfield Ong, Assistant United States Attorney. U.S. Parole
and Probation appeared by Officer James Thomas.
Court conducted the following procedures in accordance with
Fed. R. Crim. P. 32.1(a)(1) and 18 U.S.C. Â§ 3583:
Court advised Defendant Edwards of his rights and provided
him with a copy of the petition. Defendant Edwards waived his
right to a preliminary hearing.
After being placed under oath, Defendant Edwards admitted
violation 1, 2, and 4. [Docket No. 2.]
allegations to which Defendant admitted, as fully set forth
in the petition, are:
Regarding violation 2, the defendant pled guilty to the
lesser included offense of Sexual Misconduct with a Minor, a
Class D Felony.
government orally moved to dismiss violation 3 and the Court
parties stipulated that:
(a) The highest grade of violation is a Grade B violation.
(b) Defendant's criminal history category is VI.
(c) The range of imprisonment applicable upon revocation of
supervised release, therefore, is 21 to 24 months'
7. The parties jointly recommended a sentence of 12 months
and 1 day with no supervised release to follow. Defendant
